Read this online waiver form (for parents, guardians, or athletes 18 and older) then accept the waiver.  If we do not receive your agreement to this waiver form during registration, then you cannot start your evaluation or training.

I, the participant and parent or guardian, (if participant is under age 18), in consideration for my participation in TRAIN110 Program(s), do hereby covenant and agree to the following:

WAIVER AND RELEASE - I acknowledge and agree that:

• By signing this document, I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH TRAIN110, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

• I certify that I have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in activities provided. My Participation in the TRAIN110 programs is voluntary and I assume all risk of injury or contraction of any illness or medical condition that may result, or the aggravation of any pre-existing medical condition I may have or arising out of my participation in programs or activities. I understand and acknowledge that TRAIN110 has made no guarantee of success or improvement because of my participation in any programs.

• I acknowledge that this Accident Waiver and Release of Liability Form will be used by TRAIN110 LLC in the activity in which I participate and that it will govern my actions and responsibilities during my participation.

In consideration of my application and permitting myself to participate in activities, I hereby act for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

 

(A) I WAIVE, RELEASE, AND DISCHARGE from all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from activities. This waiver and release of liability includes, but is not limited to, injuries that result (a) use of any exercise equipment or facilities provided by TRAIN110; (b) use of any exercise equipment or facilities which may malfunction, (c) TRAIN110’s improper maintenance of any exercise equipment or facilities, (d) any negligent instruction or supervision provided by TRAIN110, and (e) any injuries which occur because of slipping and falling while on TRAIN110 premises or equipment. THE FOLLOWING ENTITIES OR PERSONS: TRAIN110 LLC, Candi Swanepoel, and/or their coaches, agents, representatives, or volunteers.

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from all liabilities or claims made because of participation, whether caused by negligence or otherwise.

I acknowledge that activities may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of a facilitated activity. These risks are not only inherent to participants, volunteers, spectators, and coaches.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity. I understand and acknowledge that TRAIN110 has no expertise in diagnosing, examining, or treating any medical condition, whether existing or incurred because of my participation in a TRAIN110 program/activity provided.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

PHOTOGRAPHY/DIGITAL RECORDINGS CONSENT

I consent and agree that TRAIN110, and/or their coaches, agents, representatives, or volunteers may take photographs or digital recordings of myself and/or child as a participant during this event and use these in all media for training or promotional purposes. I further consent that my child’s identity may be revealed therein or by description text or commentary. I waive any rights, claims or interest and I understand that there will be no financial or other remuneration.

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL.

I HEREBY WAIVE ANY RIGHT THAT I MAY NOW HAVE OR WILL HAVE TO BRING ANY LEGAL ACTION AGAINST TRAIN110 LLC, CANDI SWANEPOEL, ITS EMPLOYEES, AGENTS, SUCCESSORS OR ASSIGNS, FOR ANY LIABILITIES THAT MAY RESULT, WHETHER DIRECTLY OR INDIRECTLY, FROM TRAIN110’S NEGLIGENCE.

PARENT/GUARDIAN WAIVER FOR MINORS (under 18 years old)

The Undersigned parent and or natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the Sports Camp, and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect on lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
